Welcome to Sonch.in, a proprietary learning and assessment platform operated by VKITES ("we," "our," or "us"). By accessing or using this website, mobile application, or related services ("Platform"), you agree to comply with and be legally bound by these Terms & Conditions ("Terms").
Important: If you do not agree to these Terms, please discontinue use of the Platform immediately.

By using the Platform, you agree to comply with all applicable Indian laws, including:
- Digital Personal Data Protection Act, 2023 (DPDP Act) - Governs personal data processing
- Information Technology Act, 2000 and associated rules
- Applicable consumer protection and cyber security laws
- Educational regulatory frameworks

Eligibility
You must be at least 18 years old to use the Platform independently. Users below 18 may use the Platform only under the consent and supervision of a parent or legal guardian.

Minors & Parental Consent (DPDP Compliance)
Since Sonch is primarily used by K–12 students, we adhere to strict regulations:
- We require verifiable parental or guardian consent before collecting personal data from any user under 18
- No behavioural tracking, targeted advertising, or profiling of minors is permitted under DPDP Act
- Parents/guardians are fully responsible for the minor's activity on the Platform
- Consent records are maintained as per legal requirements

Account Creation & Responsibilities
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity occurring under your account
- Providing accurate and current information
- Notifying us immediately of any unauthorized access

Intellectual Property Rights
The Platform and all associated content—including text, questions, explanations, images, code, software, assessments, analytics, AI-generated content, UI/UX, trademarks, and branding—are the exclusive intellectual property of VKITES.
AI-Generated Content Ownership
All content generated by our AI systems, including but not limited to questions, answer explanations, practice sets, and study materials, constitutes proprietary intellectual property of VKITES. This includes:
- AI systems, workflows, prompts, fine-tuning processes, and proprietary datasets developed or licensed by VKITES.
- Output generated through human-AI collaborative processes
- Derivative works created from AI-generated content
- Datasets, patterns, and insights derived from user interactions with AI systems
You acknowledge that AI-generated content may incorporate elements from various sources processed through machine learning algorithms, and all resulting output is owned by VKITES.
Strictly Prohibited:
- Copying or reproducing any content
- Reverse engineering or scraping data
- Redistributing questions, videos, study materials, or analytics
- Creating derivative works
- Commercial exploitation without permission
- Using AI-generated content to train competing AI systems
- Systematic extraction of content for dataset creation
Legal Action: Violation may result in immediate account suspension, legal proceedings, and claims for damages under applicable intellectual property laws including the Copyright Act, 1957 and Information Technology Act, 2000.

Usage Rules & Prohibited Activities
You agree not to:
- Access the Platform through unauthorized means
- Circumvent security mechanisms or attempt to hack the system
- Use bots, scripts, scrapers, or automated tools
- Distribute or publish content from the Platform
- Engage in fraud, impersonation, or harassment
- Violate any applicable laws or regulations
- Interfere with Platform operations
Any such actions will result in immediate suspension and possible legal action.

Transparency in Content Generation:
- Nature of Content: A significant portion of our educational materials is generated using advanced AI systems trained on extensive educational datasets
- Quality Control: All AI-generated content undergoes:
- Automated validation checks for consistency
- Human expert review for high-stakes examination content
- Continuous improvement based on accuracy metrics
- Regular updates to incorporate verified corrections
- Accuracy Disclaimer: While we implement rigorous quality measures, we do not guarantee 100% accuracy of AI-generated content
- User Responsibility: You acknowledge that AI-generated content should be cross-verified with authoritative sources before reliance

- You will not rely solely on our content for high-stakes decisions
- You will report inaccuracies for community benefit
- No warranty of absolute accuracy is provided or implied

Payments, Billing & Refund Policy
Payments are processed securely via Razorpay. By purchasing services, you authorize VKITES to charge your payment method.
Refund & Content Replacement Policy:
- Payments are generally non-refundable
- For AI-generated content discrepancies: If you report incorrect or defective questions that are validated by our review team, we will provide replacement questions of equal number and value within the same subject/topic within 14 days
- Content validation requires submission of verifiable evidence from authoritative sources
- Refunds for subscription fees are processed only in exceptional circumstances at our sole discretion
- Processing fees, if any, are non-refundable
Content Quality Assurance Process
Our AI-generated content undergoes multiple validation checks including: automated quality scoring, human expert review for high-stakes content, peer review mechanisms, and continuous improvement based on user feedback. However, given the AI-driven nature, absolute accuracy cannot be guaranteed.

Data Protection & Privacy (DPDP Act)
We process personal data in accordance with the Digital Personal Data Protection Act, 2023. Key principles include:
- Processing only with free, specific, informed, unconditional, and clear consent with explicit affirmative action
- Purpose Limitation: Data collected only for specified, legitimate purposes
- Data Minimization: Collecting only necessary and relevant data
- Storage Limitation: Retaining data only as long as necessary for specified purposes
- Reasonable Security Safeguards: Implementing appropriate technical and organizational measures
- Accountability: Demonstrating compliance with DPDP Act principles
- Cross-border Transfer Restrictions: Only transferring data to approved jurisdictions

- Where applicable, we appoint a Data Protection Officer (DPO) and conduct Data Protection Impact Assessments in accordance with the Digital Personal Data Protection Act, 2023 and rules notified thereunder.

- We implement Privacy by Design and by Default principles
- We notify the Data Protection Board of India of significant data breaches within 72 hours

Important Notice Regarding Content Generation:
- Substantial portions of our educational content, including questions, answers, explanations, and study materials, are generated using Artificial Intelligence (AI) systems
- While we employ rigorous quality control measures and human review processes, we do not claim 100% accuracy for AI-generated content
- AI systems may occasionally produce content with errors, inaccuracies, or inconsistencies
- You acknowledge that AI-generated content should be verified against authoritative sources and used as a supplementary learning aid
Content Quality Assurance: We continuously improve our AI systems and implement human oversight to enhance content quality. Users are encouraged to report any inaccuracies for prompt review and correction.
Service Disclaimer:
We strive to provide uninterrupted access but do not guarantee:
- Continuous or error-free availability
- 100% accuracy of AI-generated questions, answers, or explanations
- Specific academic outcomes or exam results
- Compatibility with all devices or browsers
AI Content Accuracy & Corrections Policy:
In recognition that our content is AI-generated:
- Users may report incorrect or defective questions through our designated reporting system
- For each validated and verified incorrect question reported, we will provide replacement questions of equal number and value within the same topic area
- Content validation requires verifiable references to authoritative sources (e.g., NCERT textbooks, standard reference books, official exam answer keys)
- Correction decisions are made at our sole discretion based on expert review
- We reserve the right to modify or remove any AI-generated content found to be inaccurate without prior notice
Limitation of Liability:
To the fullest extent permitted by law, VKITES is not liable for:

- Loss of profits, academic performance, or exam outcomes

- Service interruptions or technical failures
- Unauthorized access due to user negligence
- Third-party actions or content
- Inaccuracies in AI-generated educational materials despite quality control measures
Educational Use Disclaimer
Our AI-generated content is designed to supplement traditional education. It should not be used as the sole source of preparation for any examination. Always consult authorized textbooks, teachers, and official resources for definitive information.
Use of the Platform, including AI-generated content, is at your own risk.

Termination
We may suspend or terminate your access immediately for:
- Violations of these Terms
- Illegal or fraudulent activity
- Misuse of the Platform or intellectual property
- Non-payment of fees
- Requests by law enforcement
Upon termination, your right to use the Platform ceases immediately.

Dispute Resolution
All disputes shall be resolved through arbitration under the Indian Arbitration and Conciliation Act, 1996.

Decision of arbitrator: Final & binding
Subject to the arbitration clause above, courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction for matters not resolved through arbitration.
